Terms of Service
Acceptance of ChuanChuan Cloud Mobile Service Terms "Chuanchuan Cloud Phone" is independently owned by Hunan Jinshengqian Network Technology Co., Ltd. (hereinafter referred to as "Jinshengqian Technology"), and provides Internet-based related services (hereinafter referred to as "Internet services") in accordance with this Agreement and the rules published from time to time by Jinshengqian Technology. In order to obtain network services, please use the user carefully (hereinafter referred to as the user) in this agreement to accept all the terms under this agreement. If a dispute occurs, the user shall not make any substantive and procedural defense on the grounds of not reading carefully.
After the user successfully registers, Chuanchuan Cloud Mobile will give each user a user account and corresponding password, which the user is responsible for keeping; for the user account assigned to the user by Chuanchuan Cloud Mobile, the user has the rights and obligations in accordance with the law for the actions generated by the account after logging in. Users shall bear corresponding legal
responsibilities for all activities and events conducted under their user accounts.
When using ChuanChuan Cloud Mobile Services, users should ensure that the mobile phone number or contact information used is authentic and valid so that we can contact you accurately and promptly. If you choose to use a virtual number or a number provided by a third party to register or use the Service, you shall bear all risks that may arise therefrom.
Hunan Jinshengqian Network Technology Co., Ltd. (hereinafter referred to as the "Company") does not assume any responsibility if we are unable to contact you in a timely manner due to your use of a virtual number or a number provided by a third party, which in turn causes you to be unable to receive service updates, important notifications, verification codes, etc., or causes you to encounter obstacles in the use of the service, product loss, account theft, etc.
In addition, if your use of a virtual number or a number provided by a third party violates relevant laws and regulations or the Company's terms of service, the Company has the right to suspend or terminate your service without
notifying you, and you will be solely responsible for all consequences arising therefrom.
Please read carefully and fully understand this Disclaimer before using the service, and use the service only after confirming your acceptance. If you have any questions, please feel free to contact our customer service department.
Service Content
The Internet service content provided by Chuanchuan Cloud Phone is provided by Jinshengqian Technology based on actual conditions, such as user center main software download, game tool download, official event release, official forum (BBS), etc.
The User Center provides tools and software for users to download. All software and information are provided by software authors, collected and organized by netizens, searched by search engines, linked, etc. The copyright belongs to the relevant software authors and producers. The relevant software and materials are provided for users’ personal learning and research. When using the software, users must also comply with the relevant software and data usage agreements, user rules, and other regulations. Any
consequences of violation shall be borne by the user. If losses are caused to the Company, the Company has the right to claim compensation.
Change, Interruption or Termination of Service
In view of the particularity of Internet services, users agree that Chuanchuan Cloud Mobile has the right to change, interrupt or terminate part or all of the Internet services at any time. If the network service is changed, interrupted or terminated, we will not be responsible for any user or any third party, but Chuanchuan Cloud Mobile will try to notify in advance.
Users understand that Chuanchuan Cloud Mobile Phone needs to regularly or irregularly inspect or maintain the platform or related equipment that provides Internet services. If such circumstances cause the Internet service (including paid Internet services) to be interrupted within a reasonable time, Chuanchuan Cloud Mobile Phone does not need to bear any responsibility for this, but Chuanchuan Cloud Mobile Phone should notify in advance as much as possible.
If the user has any of the following behaviors, Chuanchuan Cloud Mobile will suspend the login and use of
the account assigned to the user. If ChuanChuan Cloud Mobile believes that the severity of the user's behavior is relatively low, ChuanChuan Cloud Mobile may notify the user to correct it within a specified period of time before taking suspension measures. If ChuanChuan Cloud Mobile notifies the customer to make corrections, the user should make the corrections within the notified period. If the user fails to make corrections within the notice period of Chuanchuan Cloud Mobile Phone, Chuanchuan Cloud Mobile Phone has the right to interrupt or terminate the provision of network services under this Agreement to the user at any time without assuming any responsibility to the user or any third party: If the user has corrected the behavior described in the Chuanchuan Cloud Mobile Phone notification and it has been confirmed by Chuanchuan Cloud Mobile Phone, Chuanchuan Cloud Mobile Phone will restore the login and use of the account:
The user seriously violates this agreement;
The user provides false registration identity information;
The user violates the usage rules stipulated in this Agreement;
Using the products and services of ChuanChuan Cloud
Mobile by improper means;
Violation of prohibitive provisions of the laws of the People's Republic of China;
Behavior that violates social ethics.
If ChuanChuan Cloud Mobile Phone unilaterally suspends or terminates the performance of the contract by suspending the user account in accordance with the provisions of Article 3.3, if ChuanChuan Cloud Mobile Phone is required to provide evidence, ChuanChuan Cloud Mobile Phone shall only bear the burden of proof for the fact that the user has violated the prohibitive provisions of the law and seriously violated the contract agreement within the existing technical limits of ChuanChuan Cloud Mobile Phone.
If the Internet service account registered by the user is not actually used within any consecutive 180 days, or the user does not actually use the paid Internet service within
180 consecutive days after subscribing to it, Chuan Chuan Cloud Mobile has the right to delete the account and stop providing the relevant Internet service to the user.
Rules of Use
The user agrees to register as a user of Chuanchuan Cloud Phone with his or her real identity, and ensure that the
personal identification information provided is true and complete, and bear the corresponding legal responsibilities and adverse legal consequences for any false information provided in accordance with the law and the provisions of this agreement. Users should not transfer or lend their account number or password to others. If a user finds that his account has been illegally used by others, he should immediately notify ChuanChuan Cloud Mobile. ChuanChuan Cloud Mobile assumes no responsibility for the illegal use of your account or password by others due to hacking or negligence of the user.
After a user registers as a user of ChuanChuan Cloud Mobile Phone, if he needs to modify or change the personal identification information provided, he should notify ChuanChuan Cloud Mobile Phone in the manner announced by ChuanChuan Cloud Mobile Phone and provide relevant certificates. After Chuanchuan Cloud Mobile receives the notification and reviews the relevant certificates (for the avoidance of doubt, Chuanchuan Cloud Mobile is only responsible for the formal review of the relevant documents and does not bear the substantive review of the relevant certificates), Chuanchuan Cloud Mobile will provide users
with modification and change services within a reasonable time.
ChuanChuan Cloud Mobile has the right to review the authenticity of the identity information provided by the user during registration and take necessary technical and management measures to ensure the security and effectiveness of the user account.
The user is obliged to keep the user account and password properly and use the user account and password correctly and safely in strict accordance with the provisions of this Agreement. If a user loses his password or has his account stolen due to his own reasons, which causes damage to his own and others' civil rights, Chuanchuan Cloud Mobile will not bear any legal responsibility, and the user will bear the corresponding responsibility himself, except as otherwise provided by law and otherwise agreed in this Agreement.
If a user finds that the assigned account or password is illegally used by others or is used abnormally, he/she should promptly notify ChuanChuan Cloud Mobile Phone in the manner announced by ChuanChuan Cloud Mobile Phone, and has the right to require ChuanChuan Cloud Mobile Phone to take measures to
suspend the login and use of the account.
If a ChuanChuan Cloud Phone user applies to take measures to suspend the login and use of the user account, the user shall provide ChuanChuan Cloud Phone with a valid personal identification document, and a formal review shall be conducted on the consistency between the personal identification document provided by the user and the registered identity information:
If the valid personal identification document provided by the user who is required to take measures to suspend the login and use of the account is consistent with the registered identity information, the login and use of the user account will be suspended and the user will be notified.
If, due to reasons attributable to ChuanChuan Cloud Mobile, ChuanChuan Cloud Mobile fails to take timely measures to suspend the login and use of the user's account, and causes direct losses to the user, ChuanChuan Cloud Mobile shall only be liable for the increased direct losses caused by the failure to take timely measures.
If the user fails to provide his/her personal valid identification document or the personal valid identification document provided by the user is inconsistent with the
registered identity information, Chuanchuan Cloud Mobile will reject the user's request to suspend the login and use of the user's account.
In order to safeguard their legal rights and interests, when users provide Chuanchuan Cloud Mobile with valid personal identification documents that are consistent with the registered identity information, Chuanchuan Cloud Mobile will provide the user with necessary assistance and support, and provide relevant evidence information to relevant administrative and judicial authorities as needed.
Users agree to accept product promotions or other related commercial information sent to users by Chuanchuan Cloud Mobile via email or other means.
Users enjoy copyright and other relevant legal rights over the content they create and upload to Chuanchuan Cloud Mobile through Chuanchuan Cloud Mobile Internet Service (including but not limited to forums). For any content that users upload to the publicly available area of the ChuanChuan Cloud Mobile website through the ChuanChuan Cloud Mobile Internet Service, users agree that ChuanChuan Cloud Mobile has the free, permanent, irrevocable right and license to use, copy, modify, translate, create derivative works based
on, disseminate, perform and display such content worldwide.
When using the ChuanChuan Cloud Mobile Network Service, users must follow the following principles:
Comply with relevant Chinese laws and regulations;
Comply with all network protocols, regulations and procedures of ChuanChuan Cloud Mobile;
You may not use the Internet service system for any illegal purpose;
You may not use the ChuanChuan Cloud Mobile Network Service System to conduct any behavior that may adversely affect the normal operation of the network or ChuanChuan Cloud Mobile;
You may not use the Internet services provided by ChuanChuan Cloud Mobile to upload, display or disseminate any false, harassing, defamatory, abusive, threatening, vulgar, obscene or any other illegal information;
You may not infringe upon any third party’s patent rights, copyrights, trademark rights, reputation rights or any other legal rights;
If any illegal use of user accounts or security vulnerabilities are discovered, ChuanChuan Cloud Mobile should be notified immediately.
If a user violates any of the above provisions when using the Internet service, Chuanchuan Cloud Mobile or its authorized person has the right to require the user to make corrections or directly take all necessary measures (including but not limited to changing or deleting the content posted by the user, suspending or terminating the user's right to use the Internet service) to mitigate the impact of the user's improper behavior. If Chuanchuan Cloud Mobile Phone applies the provisions of this paragraph to suspend the user account and unilaterally suspend or terminate the performance of the contract, if Chuanchuan Cloud Mobile Phone is required to provide evidence, Chuanchuan Cloud Mobile Phone shall only bear the burden of proof for the fact that the user has violated the prohibitive provisions of the law and seriously violated the contract agreement within the existing technical limits of Chuanchuan Cloud Mobile Phone.
When users use their registered user center account to accept software, tools, email and other related services provided by ChuanChuan Cloud Mobile, it should be deemed that the user has agreed to the specific (dedicated) service agreements and related rules of the relevant software, tools,
email and other services and promised to comply with them. Users should proactively check the homepage (official website) of the relevant service for the specific (dedicated) service agreement and related rules referred to above. If users have any objections to the service agreement and related rules, they should proactively terminate the relevant service.
Any statements, notifications, warnings, etc. made by ChuanChuan Cloud Mobile regarding the use of certain specific ChuanChuan Cloud Mobile Network Services through various means (including but not limited to web page announcements, e-mails, text message reminders, etc.) shall be deemed as part of this Agreement. If users use such ChuanChuan Cloud Mobile Network Services, it shall be deemed that the users agree to the contents of such statements, notifications, and warnings. If the user has any objection to the statement, notification or warning, he/she should proactively terminate the relevant service.
Intellectual Property Rights
Any text, images, graphics, audio and/or video materials contained in the Internet services provided by Chuanchuan Cloud Mobile are protected by copyright, trademark and/or
other property ownership laws. Without the consent of the relevant rights holders, the above materials shall not be directly or indirectly published, broadcast, rewritten or redistributed for the purpose of broadcast or publication in any media, or used for any other commercial purpose. All of these materials or any part of them may be stored on a computer for private and non-commercial use only. Chuan Chuan Cloud Mobile shall not be responsible in any form to the user or any third party for any delays, inaccuracies, errors and omissions arising from the above information or in the process of transmitting or submitting all or part of the above information, or for any damages arising therefrom.
All rights to any software used by ChuanChuan Cloud Mobile to provide Internet services (including but not limited to any images, photos, animations, videos, recordings, music, texts and additional programs, and accompanying help materials contained in the software) belong to the copyright owner of the software. Users may not reverse engineer (reverse program settings) the software without the permission of the copyright owner of the software.
Privacy Policy
During your use of this product, we may collect information
you provide when using the service or that is generated by using the service in order to provide you with ChuanChuan Cloud mobile phone business functions, optimize our services, and protect the security of your account. For example, we will collect your device account, order number login information, and the account you provide through the method you actively provide or obtain system permissions after your authorization. Protecting user information and privacy is one of our basic principles. Except as otherwise provided in this Agreement, our collection, use and protection of user information will comply with the provisions of ChuanChuan Cloud's Privacy Policy.
Disclaimer
ChuanChuan Cloud Mobile does not guarantee the accuracy and completeness of the external links set up to provide convenience to users. At the same time, ChuanChuan Cloud Mobile does not assume any responsibility for the content on any web pages that such external links point to and are not actually controlled by ChuanChuan Cloud Mobile.
Chuanchuan Cloud Mobile has the right but not the
obligation to improve or correct any omissions or errors in any part of the Service.
ChuanChuan Cloud Mobile does not guarantee (including but not limited to)
The network service is suitable for the user's requirements;
The Internet service will not be interrupted, timely, secure, reliable or error-free, including hacker intrusion, Internet interruption, telecommunication problems and other force majeure;
Any products, services or other information obtained by users through online services meet the users' expectations;
Chuanchuan Cloud Mobile Phone does not assume any responsibility for any interruption of network service or other defects caused by force majeure or reasons beyond the control of Chuanchuan Cloud Mobile Phone, but will try its best to minimize the losses and impacts caused to users.
The user agrees that Chuanchuan Cloud Mobile does not need to bear any responsibility for the quality defects of the services provided by Chuanchuan Cloud Mobile to the user and any losses caused by them.
If any third party makes a claim due to the user posting
or transmitting content through ChuanChuan Cloud Mobile, violating the Terms of Service or infringing any rights of others, the user agrees to compensate ChuanChuan Cloud Mobile and its branches, affiliates, agents or other partners and employees, and protect them from harm.
Modification of the Agreement
ChuanChuan Cloud Mobile has the right to modify any terms of this Agreement at any time. Once the content of this Agreement changes, ChuanChuan Cloud Mobile will notify users of the modified content through web page announcements and other means.
If the user disagrees with the changes made by ChuanChuan Cloud Mobile to the relevant terms of this Agreement, the user has the right to stop using the Internet service. If the user continues to use the Internet service, it will be deemed that the user accepts the changes made by Chuanchuan Cloud Mobile to the relevant terms of this Agreement.
Service of Notices
All notifications from ChuanChuan Cloud Mobile to users under this Agreement may be made through web page
announcements, emails, etc.; such notifications shall be deemed to have been delivered to the recipient on the date of sending.
Notifications from users to ChuanChuan Cloud Mobile should be delivered through the contact information such as the mailing address, fax number, etc. officially published by ChuanChuan Cloud Mobile.
Special tips for young users
Young users must abide by the National Youth Internet Civility Convention:
Be good at online learning and do not browse bad information; communicate honestly and friendly and do not insult or defraud others; strengthen self-protection awareness and do not date netizens casually; maintain network security and do not disrupt network order; be beneficial to physical and mental health and do not indulge in virtual time and space.
Governing Law
The conclusion, execution, interpretation and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China and shall be subject to
the jurisdiction of Chinese courts.
If any dispute arises between the parties regarding the content of this Agreement or its execution, the parties shall try to resolve it through friendly negotiation; if the negotiation fails, either party may file a lawsuit with the People's Court of the place where ChuanChuanYun Company is registered.
Other Provisions
This Agreement constitutes the complete agreement between the parties on the agreed matters of this Agreement and other related matters. Except as provided in this Agreement, no other rights are granted to the parties to this Agreement.
If any clause in this Agreement is wholly or partially invalid or unenforceable for any reason, the remaining clauses of this Agreement shall remain valid and binding.
The headings in this Agreement are for convenience only and shall be ignored in interpreting this Agreement.
